BETWEEN: AMANI PATH ("Company") and the Customer (online purchaser/user)
CONSUMER PROTECTION ACT (CPA) s49
The clauses listed below limit risk or liability, impose obligations on you, or require acknowledgements of fact.They are displayed prominently here and again near each clause. By placing an order or ticking the acceptance boxes at checkout, you confirm these provisions were drawn to your attention and you accepted them:
• Clause 2: No Guarantee of Outcome (limits liability regarding government decisions).
• Clause 4: Refunds & Cancellations (when refunds apply/do not apply).
• Clause 9: Limitation of Liability (scope of liability cap; statutory carve‑outs).
1. SERVICES AND SCOPE
1.1 We provide immigration information, visa and permit application facilitation, and administrative supportthrough the Department of Home Affairs (DHA), VFS Global and other authorities. We do not issue passports,obtain official stamps, guarantee approvals, or control outcomes or timelines. Services are lawful and professional at all times.
1.2 Scope may include: Digital guides, temporary residence visas (work, study, relative, life partner, spousal);permanent residence and citizenship‑related submissions; visa waivers and certain appeals to DHA. We do not provide representation in deportation proceedings, criminal matters, detention challenges, or litigation concerning bans/V‑list removals. We will refer you to an attorney/advocate if legal representation is required.
1.3 We render professional consulting services (no sale of physical goods). Services include consultations,document preparation, liaison with authorities and case coordination.
1.4 Immigration consulting is not regulated by a statutory professional council; Amani Path is not a law firm and does not provide legal representation. Clients who need legal advice/representation in court or quasi‑judicial proceedings should engage an admitted attorney/advocate.
2. NO GUARANTEE OF OUTCOME
2.1 All immigration decisions (approvals/refusals/conditions/timelines) are taken solely by DHA and other authorities. We have no control over those decisions.
2.2 We use reasonable care and skill, but no outcome is guaranteed. Fees are charged for professional services rendered, not for a particular governmental result.
2.3 A refusal, cancellation, delay, or adverse condition imposed by authorities does not entitle you to a refund of our service fees.
3. CLIENT WARRANTIES, RESPONSIBILITIES AND DOCUMENTATION
3.1 Authenticity. You warrant all information/documents supplied are true, authentic and lawfully obtained. Providing false/forged documents may constitute a criminal offence and can lead to immediate termination without refund and mandatory reporting to authorities.
3.2 Your responsibilities:
• Pay consulting and service fees; attend required appointments; present original documents when required.
• Monitor communications from DHA, VFS and other authorities and promptly notify us.
3.3 We do not control government processing timelines, decisions or policy changes.
4. PAYMENT, REFUNDS, AND COMMENCEMENT OF WORK
4.1 Commencement. Work starts once (a) you accept these terms, and (b) payment is received.
4.2 Refund Policy — www.amanipath.com/refund-policy
• Change‑of‑mind (goodwill): If no services have begun and any digital asset has not been downloaded/activated,request a 100% refund within 30 days of cleared payment. We process within 30 days of your written notice.
• Online purchases (e‑commerce): For electronic transactions by consumers, you may cancel goods (including digital files) within 30 days of receipt and payment. Refunds are processed within 30 days of your cancellation notice. Statutory exceptions may apply; see Refund policy for details.
• Cancellation at any other time: You may cancel at any time. Any charge will be reasonable with reference to the nature of services, length of notice, our realistic ability to rebook, and industry practice (default guide listed in the Refund policy).
• Third‑party disbursements: DHA, VFS, medicals, police clearances, notaries, couriers and similar third‑party costs are non‑refundable once incurred.
5. FEES AND PAYMENT TERMS
5.1 Service fee: As per agreed scope (or as shown per product/service online).
5.1.1 Includes: authority liaison, VFS coordination, DHA coordination, admin where applicable, case management, document prep and client updates.
5.1.2 Excludes (client’s cost): police clearances; medicals; courier; notaries; government submission fees; VFS premium lounge (if chosen); and items not listed in 5.2.
5.2 Payment confirms an irrevocable commitment to proceed (subject tanyo applicable cooling‑off rights).
5.3 Product‑based pricing and timelines (ECTA s43). Pricing (including all fees/taxes) and delivery/fulfilment timelines may differ depending on the specific product/service purchased (Digital assets). The applicable price and timeline for your purchase are disclosed on the relevant product page/quote/checkout and form part of this Agreement.
6. GOVERNMENT COMMUNICATIONS
You are responsible for monitoring DHA/VFS communications and promptly notifying us. We are not liable for missed appointments, deadlines, or delays caused by non‑notification or late information. VFS charges separate fees not set by Amani Path.
7. CONFIDENTIALITY, DATA PROTECTION & ETHICAL CONDUCT
We process personal information to perform this contract and/or with your consent, retain records as required by law, disclose to DHA/VFS where required, and comply with our Privacy Policy. You may exercise data‑subject rights via hello@amanipath.com or lodge complaints with the Information Regulator. You must not request unlawful activity; we may terminate immediately and report such conduct.
8. DEFAMATION AND FRAUDULENT STATEMENTS
Nothing restricts your right to honest opinion, truthful reviews, complaints to authorities/ombuds, or protected expression. Knowingly false statements of fact that cause reputational harm may give rise to civil remedies. This clause is not a non‑disparagement agreement. Survives termination.
9. LIABILITY LIMITATIONS
Subject to the CPA and applicable law, our total liability for damages arising from our services is limited to the total service fees paid, except that we do not limit or exclude liability for gross negligence, wilful misconduct or fraud, or any liability that cannot be limited under the CPA. If we supply goods in conjunction with services, statutory product‑liability rules may apply. You accept the risks of government decisions and processing outcomes beyond our control.
10. TERMINATION, DISPUTE RESOLUTION & GOVERNING LAW
We may terminate immediately (no refund of service fees) if you breach this Agreement, supply false information,request unlawful activity, or fail to pay. You may terminate at any time by written notice; you remain liable for fees for services already completed, third‑party disbursements, and a reasonable charge for work‑in‑progress. Either party may approach the NCC/appropriate ombud/tribunal or a court at any time. Governing law: Republic of South Africa.
11. MANDATORY LEGAL RIGHTS
Nothing in this Agreement excludes or limits your non‑excludable rights under the Consumer Protection Act or POPIA; if inconsistency arises, the law prevails.
12. ONLINE PUBLICATION & ACCEPTANCE
12.1 ECTA s43 Disclosures. When you purchase online, our mandatory supplier and transaction disclosures are published at www.amanipath.com and can be found at www.amanipath.com/ECTA-43-Disclosures, including identity and contact details, full price including fees/taxes, delivery/fulfilment timelines, refund/cooling‑off policy, privacy/security, and any minimum duration. This page is incorporated by reference into this Agreement.
12.2 Review / correct / withdraw step. Our checkout flow allows you to review your order, correct any mistakes, and withdraw before placing your order. By placing your order, you confirm you had that opportunity.
12.3 Click‑through acceptance (CPA s49). At checkout you will be asked to confirm that you have read and accept this Agreement and the Refund & Cancellation Policy, and to separately acknowledge the important provisions in Clauses 2, 4 and 9.
12.4 Electronic notices (ECTA s23). We send confirmations and notices electronically. A data message is treated as sent when it leaves our information system and received when it reaches your designated system and is capable of being retrieved.
